Installer Locator Terms and Conditions

Please read the following terms and conditions carefully.

1. By agreeing to access Navien’s list of installers and service providers (hereafter “Listing”), you agree that the Listing is provided for your convenience only and you will not rely on the Listing to make your hiring decision. The Listing shows installers and service providers (“Installers”) that 1) had at least one team member who received training on Navien, Inc. product(s), and 2) requested to be listed on the Listing. Installers with an NSS logo indicate attendance in more in-depth training on Navien, Inc. products. Navien does not guarantee the information provided in the Listing is accurate or up to date. When browsing Installers, we suggest you ask when the Installers last attended any training. If you find any out of date or inaccurate information, please call us at 800-519-8794, Option 3.
2. You represent and warrant that Navien, Inc. has no liability whatsoever concerning: 1) The workmanship of any third parties or parties listed in the Listing, 2) The installation of use of Navien, Inc.’s products including, but not limited to, effects on indoor pollutants, and 3) any other matter with respect to the Listing, your choice of use from the Listing, and the work performed by the Installers/Independent third party contractors from the Listing.
3. Third-Party Installers and Services: Navien, Inc. provides a list of independent third-party installers on our website solely for your convenience. These installers are NOT employees, agents, partners, or subcontractors of Navien, Inc. We do not endorse, recommend, guarantee, or warrant the quality, professionalism, or performance of any third-party installer or their services. Your decision to engage any third-party installer from our list, or any other installer, is entirely at your own discretion and risk. Any agreement for installation or other services is directly between you and the chosen installer. Navien, Inc. expressly disclaims all liability for any and all damages, losses, injuries, or claims arising from or in connection with the services provided by any third-party installer, including but not limited to, issues with installation, workmanship, product damage during installation, delays, or any other matter related to their services. We strongly recommend you to: 1) Conduct your own independent research and due diligence on any installer before engaging their services, 2) Obtain multiple quotes and check references, 3) Verify their licensing, insurance, and qualifications, 4) Ensure a clear written contract is in place with the installer, detailing the scope of work, timeline, costs, and their liability, and/or 5) Address any and all claims or disputes directly with the third-party installer.
4. Severability: If any provision of this Terms and Conditions is held to be invalid, illegal, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions of this Agreement shall not in any way be affected thereby. Such invalid, illegal, or unenforceable provision shall be severed from this Agreement.
5. Governing Law: Any action and/or conflicts related to these Terms and Conditions shall be governed and construed by the law of Orange County, the State of California to resolve any interpretations or dispute arising from this Terms of Use.
