(“Navien,” “we,” “us,” or “our”) collects, uses, discloses, and protects Personal Information when you visit, access, or use our websites, webpages, online forms, digital tools, mobile applications, and other online services that link to this Privacy Policy (collectively, the “Site”).  
Please read this Privacy Policy carefully. If you do not agree with this Privacy Policy, please do not access or use the Site.  
 
Introduction and Definitions  
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household. Personal Information does not include information that is publicly available, deidentified, aggregated, or otherwise excluded from the scope of applicable privacy laws.  
 
This Privacy Policy may be supplemented by additional notices, including state-specific privacy notices, mobile application notices, cookie notices, or notices presented at the time of collection.  
 
References to the “NaviLink App” include the NaviLink App, the Navien Sphere App, and any successor or replacement Navien mobile application used to connect, monitor, control, or support compatible Navien products. 

Types of Information We Collect  
Depending on how you interact with us, we may collect the following categories of Personal Information: 

• Contact and identifying information, such as your name, postal address, ZIP code, email address, telephone number, account information, or similar identifiers. 
• Product, warranty, and service information, such as product model, serial number, installation date, installation address, service history, warranty registration information, and related correspondence. 
• Installer, contractor, or business information, such as installer name, business name, business address, telephone number, email address, product-specific details, and installation records. 
• Installation images and related quality-assurance materials, including pre-installation and post-installation photographs submitted for registration, warranty validation, training, quality assurance, or service record purposes. Installers and other submitting parties are responsible for ensuring that submitted images do not contain unnecessary Personal Information of third parties or sensitive information. 
• Internet, device, and network activity information, such as IP address, device identifiers, browser type, operating system, pages viewed, links clicked, referring URLs, search or navigation activity, video engagement, form interactions, product-interest signals, and other information about your interactions with the Site. 
• NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application, and connected device information, such as user account identifiers, including user ID or email address, connected device identifiers, connected device MAC address, app usage information, device status information, installation-related information, network information, IP address, browser or device information, operational status information, diagnostic information, and other information associated with the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application or a connected Navien device.
• Commercial and preference information, such as products or services purchased, obtained, considered, registered, or viewed; rebate, installer locator, service locator, distributor locator, or sales representative locator activity; and communication preferences. 
• Location information, such as ZIP code, approximate location derived from IP address, general location information derived from installation information, such as state or city, or precise geolocation if you choose to enable precise location-based features, such as the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application real-time weather feature.
• Inferences or audience information, such as commercial profiles or audience segments based on product categories, rebate research, warranty or service activity, installer/service locator activity, product engagement, or other interactions with the Site. 
• Communications and inquiry information, such as information you provide through contact forms, customer service requests, product registration forms, warranty forms, event registrations, surveys, reviews, testimonials, or similar communications. 
• Sensitive Personal Information, where applicable and only as needed for a specific purpose, such as precise geolocation if you enable location-based features, payment-related information if needed for a transaction, or government-issued identification information where required for a specific business, employment, verification, or legal purpose. 

We use Sensitive Personal Information only for purposes permitted by applicable law, such as providing requested services, processing transactions, ensuring security, preventing fraud, complying with legal obligations, or providing location-based functionality you request. We do not use Sensitive Personal Information to infer characteristics about you. 

How Personal Information Is Collected  
We collect Personal Information in the following ways: 

• To respond to your inquiries, requests, and communications. 
• To provide, operate, maintain, secure, personalize, and improve the Site, our products, services, and digital tools. 
• To process product registrations, administer warranties, validate installation information, maintain service and repair histories, and support quality assurance. 
• To provide location-based features, including localized rebate information, installers, service providers, distributors, sales representatives, and real-time weather guidance where enabled. 
• To send service, transactional, warranty, safety, recall, administrative, or other non-marketing communications. 
• To send marketing communications, product updates, promotional communications, event information, or other communications where permitted by law or with your consent where required. 
• To analyze trends, measure engagement, evaluate advertising performance, create audience segments, perform campaign measurement, conduct market research, and understand customer interests. 
• To prevent fraud, protect the security and integrity of the Site and our systems, debug problems, enforce our terms, and protect our rights, property, employees, customers, users, and the public. 
• To comply with legal, regulatory, tax, accounting, warranty, product safety, and recordkeeping obligations, respond to lawful requests, and establish, exercise, or defend legal claims. 
• To evaluate or conduct a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar business transaction. 

For users of the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application who enable the real-time weather feature, we may use precise geolocation data to provide localized weather information and related app functionality. This precise geolocation data is processed and used specifically for the weather guidance service and related support for that feature. 
 
Information automatically collected through the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application or connected Navien devices, including connected device MAC address, app or device telemetry, operational status information, diagnostic information, and general location information derived from installation information, such as state or city, may be used to monitor service availability, product performance, device operation, system status, connectivity, error conditions, and other diagnostic or support needs. This information may also be used to troubleshoot issues, improve connected-device functionality, maintain service reliability, and support warranty, safety, and customer service activities. We do not use connected device MAC addresses or NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application diagnostic information for advertising or marketing purposes.

Disclosure of Personal Information  
We may disclose Personal Information to service providers, contractors, vendors, and other third parties that help us operate our business, administer the Site, process forms and registrations, provide customer service, manage warranties and service records, host or store information, provide CRM and marketing services, send communications, obtain reviews or testimonials, provide analytics, measure advertising performance, and support advertising or remarketing activities where permitted by law and subject to your privacy choices.  
 
These parties may include cloud-based form, database, CRM, email marketing, customer support, workflow-management, analytics, advertising technology, and similar business service providers. We may also disclose limited identifiers, internet or electronic network activity information, commercial information, geolocation information, and inferences to advertising, analytics, and social media platforms for cross-context behavioral advertising, targeted advertising, campaign measurement, audience matching, and similar purposes, subject to applicable law and your opt-out rights.  
 
We may disclose Personal Information to installers, contractors, service providers, distributors, sales representatives, or other business partners as needed to respond to your requests, provide requested services, process registrations, provide warranty or service support, or otherwise operate our business.  
 
We may disclose Personal Information where required or permitted by law, including in response to subpoenas, court orders, regulatory requests, legal proceedings, law enforcement requests, or other legal obligations. We may also disclose Personal Information when we believe disclosure is necessary to protect Navien, our employees, customers, users, business partners, rights, property, safety, or the public.  
 
We may disclose Personal Information in connection with a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar business transaction.  

To provide the real-time weather guidance feature within the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application, we may disclose location data to our weather API provider, WeatherAPI.com, solely for the purpose of returning localized weather information and supporting that feature.  
 
For NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application and connected device services, we may share limited automatically collected information with our parent company and affiliates located in Korea for product operation, service availability monitoring, performance monitoring, diagnostic, support, security, warranty, product improvement, and related business purposes. This information may include masked account identifiers, connected device MAC address, device status information, diagnostic information, and general location information derived from installation information, such as state or city. We do not share raw latitude/longitude coordinates collected for the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application real-time weather feature with our parent company in Korea.

Marketing Communications  
If you choose to receive marketing communications from us, we may use your contact information to send product updates, promotional communications, event information, warranty-related communications, or other information that may be of interest to you. Where required by law, we will obtain your express consent before sending marketing emails, text messages, or similar electronic communications. Consent to receive marketing emails is separate from consent to receive text messages. You may opt out of marketing communications as described in the message or by contacting us.  
 
Your Privacy Rights  
Depending on where you reside, you may have specific rights regarding your Personal Information. These rights may include the right to request access to or confirmation of our processing of your Personal Information, to request correction or deletion of Personal Information, to request a copy of Personal Information in a portable format, to opt out of certain processing activities, including sale, sharing, targeted advertising, or profiling where applicable, and to limit the use or disclosure of Sensitive Personal Information where required by law.

California, Colorado, Virginia, and other state residents may have additional rights as described in applicable state-specific privacy notices. We may verify your request by matching information you provide with information we maintain, such as name, email address, postal address, state of residence, or other information reasonably necessary to verify your identity and process your request.  

We do not sell Personal Information for money. However, we may “share” Personal Information under California law or process Personal Information for “targeted advertising” under other state privacy laws by disclosing identifiers, internet or electronic network activity information, commercial information, geolocation information, or inferences to advertising, analytics, and social media platforms. You may opt out of these activities through our cookie or privacy preference tools, by using any applicable “Do Not Sell or Share My Personal Information” or similar link, or through legally recognized opt-out preference signals, such as Global Privacy Control, where required by law.  
We will not discriminate against you for exercising privacy rights provided by applicable law.  

For California residents, precise geolocation information may be considered Sensitive Personal Information under the CCPA/CPRA. We use precise geolocation collected through the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application only for limited purposes, such as providing the real-time weather feature, related support, security, or service functionality. We do not use precise geolocation collected for the real-time weather feature to infer characteristics about you, for advertising or marketing, or to share raw latitude/longitude coordinates with our parent company in Korea.

Retention of Personal Information  
We retain Personal Information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide services, administer warranties, maintain service records, comply with legal and regulatory obligations, resolve disputes, enforce agreements, prevent fraud, and establish, exercise, or defend legal claims. Retention periods may vary depending on the type of information, the purpose for which it was collected, legal requirements, warranty or product safety obligations, and our legitimate business needs.  

Protection of Information  
Navien maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of Personal Information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. 

PLATFORM-SPECIFIC DISCLOSURES 

Navien Branded Storefront/Navienportal.com. 
We may collect and process Personal Information when you use Navienportal.com or other Navien-branded storefronts operated by or on behalf of Navien, including account registration information, billing and shipping contact information, order details, transaction history, payment-related information, customer service communications, IP address, browser information, device metadata, cookies, and similar technical information. 
 
Navienportal.com is operated with support from third-party service providers, including The Shamrock Companies or similar vendors, who may process Personal Information on Navien’s behalf to operate the storefront, process orders, coordinate payment processing, provide customer support, fulfill and ship merchandise, manage returns or exchanges, maintain transaction records, and support website functionality, fraud prevention, and security. 
 
We may use strictly necessary cookies and similar technologies to operate the storefront, maintain sessions, support cart and checkout functionality, process transactions, prevent fraud, and secure the site. If analytics, advertising, or other non-essential tracking technologies are used on the storefront, those technologies will be disclosed and managed through applicable cookie consent or preference tools where required by law. 

NavienRewards/Contractor Rewards Program. 
We may collect and process Personal Information when you participate in NavienRewards or other Navien contractor, installer, service provider, or partner rewards programs. This information may include your name, business name, business email address, telephone number, account identifiers, program eligibility information, product registration activity, reward points or earnings ledger records, redemption history, support inquiry submissions, communications, IP address, browser information, device metadata, cookies, and similar technical information. 
 
NavienRewards may be accessed through the Navien Partners Portal or other Navien systems using single sign-on or account-linking functionality. We may process account identifiers, email addresses, authentication tokens, redirect information, linked account status, and related technical information to facilitate access between Navien systems and NavienRewards. 
 
NavienRewards is operated with support from third-party service providers, including Workstride or similar rewards program vendors, who may process Personal Information on Navien’s behalf to administer the rewards program, maintain account profiles, track reward earnings, process redemptions, provide customer support, send program communications, maintain transaction and audit records, and support platform functionality, fraud prevention, and security. 
 
We use Personal Information collected through NavienRewards to administer the rewards program, verify eligibility, maintain accurate rewards balances and transaction histories, process redemptions, respond to support inquiries, detect or prevent fraud or misuse, comply with tax, accounting, legal, and recordkeeping obligations, and improve the program and related services. 
 
We may use strictly necessary cookies and similar technologies to operate NavienRewards, authenticate users, maintain sessions, secure accounts, prevent fraud, and provide requested program functionality. If analytics, advertising, or other non-essential tracking technologies are used on NavienRewards, those technologies will be disclosed and managed through applicable cookie consent or preference tools where required by law. 

NaviSizer/Naviensizing.com. 
We may collect and process Personal Information and project-related information when you use Naviensizing.com, NaviSizer, or other Navien sizing, calculation, design, or product-selection tools. This information may include your name, email address, company or project information, project names, ZIP code or postal code, geographic inputs used for groundwater or regional calculations, mechanical or plumbing specifications, fixture counts, system requirements, product selections, generated sizing reports, download activity, IP address, browser information, device metadata, cookies, and similar technical information. 
 
Naviensizing.com and related sizing tools may be operated with support from third-party service providers, including RedBarn or similar vendors, who may process information on Navien’s behalf to host and operate the sizing utility, perform calculations, generate reports, maintain user sessions or saved jobs, provide technical support, improve tool functionality, and support website security. 
 
We use information collected through NaviSizer and related tools to provide unit selection assistance, generate sizing outputs and reports, support contractors, engineers, or users in evaluating potential product configurations, improve our tools and products, respond to inquiries, maintain business records, troubleshoot technical issues, and comply with applicable legal, warranty, product safety, and recordkeeping obligations. 
 
Outputs from NaviSizer and similar tools are provided for informational and assistance purposes only. The contractor, engineer, installer, or other responsible professional remains responsible for determining the appropriate model, components, accessories, system design, and installation requirements and for ensuring compliance with applicable building codes, regulations, site conditions, and professional standards. 
 
We may use strictly necessary cookies and similar technologies to operate the sizing tool, maintain sessions, support saved jobs, generate reports, secure the site, and provide requested functionality. If analytics, advertising, session replay, or other non-essential tracking technologies are used on Naviensizing.com, those technologies will be disclosed and managed through applicable cookie consent or preference tools where required by law. 

NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application and Connected Devices. 
If you use the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application or connect a compatible Navien device to the NaviLink App/Navien Sphere App or related Navien services, we may collect and process account identifiers, connected device MAC address, app or device telemetry, operational status information, diagnostic information, installation-related information, network information, and general location information derived from installation information, such as state or city. We use this information to operate and support connected-device services, monitor service availability, evaluate product performance, diagnose errors, maintain service reliability, support warranty and customer service activities, and improve connected-device functionality. We do not use connected device MAC addresses or NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application diagnostic information for advertising or marketing purposes. 
 
If you enable the NaviLink App, Navien Sphere App, or any successor or replacement Navien mobile application real-time weather feature, we may process precise geolocation data to provide localized weather information and related support for that feature. Raw latitude/longitude coordinates collected for the real-time weather feature are not shared with our parent company in Korea and are not used for advertising or marketing purposes.

Non-Confidential Information  
If you send us ideas, comments, suggestions, questions, concepts, techniques, or similar feedback regarding Navien’s products, services, or the content of the Site, we may use, disclose, or distribute that information without restriction, unless we have entered into a separate written agreement with you that provides otherwise. You understand that you submit such feedback without any promise or expectation of compensation, royalties, attribution, recognition, or other benefit.  
 
Links to Third-Party Sites  
The Site may contain links to third-party websites, platforms, tools, forms, or services. Your use of third-party sites and services is governed by the privacy policies and terms of those third parties, not this Privacy Policy. We encourage you to review the privacy policies of those third parties before providing information to them.  
 
Notice to Residents of the European Economic Area, United Kingdom, or Switzerland  
If you are located in the European Economic Area, United Kingdom, or Switzerland, additional privacy rights and disclosures may apply. We process Personal Information for the purposes described in this Privacy Policy, including responding to requests, managing the Site, providing products or services, supporting health, safety, and legal obligations, improving our offerings, and conducting marketing where permitted by law.
